Gag Law, 54 articles for a \u00absocial re-education\u00bb.\u00bb<\/h2>\n

The call \u2018Gagging law<\/strong>\u2018 is the name by which its detractors refer to the Organic Law on the Protection of Public Security<\/strong> which the Popular Party approved with its majority in the Congress of Deputies in December 2014.<\/p>\n

The 54-article law was presented as a preliminary draft in November 2013 and is based on the articles of a previous law, the Organic Law for the Protection of Citizen Security, which was elevated to its rank by another popular government, that of Jos\u00e9 Mar\u00eda Aznar. The law is highly controversial in its articles, both in terms of the number of punishable actions and the increase in the severity of their enforcement.<\/a>,The law was the subject of several appeals of unconstitutionality, which were finally rejected by the Spanish Constitutional Court. A law that reinforces the need for criminal lawyers<\/a> to defend what in many cases used to be nothing more than a misdemeanour that was remedied by the payment of a fine and which seems to be given more importance than the pursuit of the innumerable cases of political corruption in Madrid<\/a> in recent years.<\/p>\n

The \u2018The \u2019Ley Mordaza' introduced the concept of revisable permanent imprisonment.<\/strong>, According to its detractors, a euphemism that is nothing more than a \u2018disguised life sentence\u2019, which, they point out, goes against the spirit of the Spanish Constitution and several of its articles.<\/p>\n

The permanent revisable prison was an electoral commitment made by the Popular Party to favour a tougher system of redemption in blood crimes and in the face of the new boom in terrorism, other crimes against sexual freedom and those involving minors.<\/p>\n

Demonstrations against the gagging law
\n<\/strong><\/h2>\n

The \u2018Ley Mordaza\u2019 also provides for heavy penalties in the case of unauthorised demonstrations and public calls for protests, which can be up to 600,000 euros if they take place on pre-election days, it seems that soon all citizens will have to have our trusted law firm to know what is allowed and what is not.<\/p>\n

Similarly, fines are imposed for protests during solemn acts and religious services. The letter of the law considers the areas surrounding the buildings of the Congress of Deputies and the Senate as areas unsuitable for protests while parliamentary activities are taking place. It is not an exemption that the convocations have been announced in advance.<\/p>\n

Unauthorised gatherings on the public highway will result in fines of between 100 euros and 600 euros for each of the documented guilty attendees, and between 600 euros and 30,000 euros in the case of rallies next to parliamentary seats; the amount varies depending on whether or not the rally is being called. Refusal to dissolve any unauthorised rally carries the same financial penalty.<\/p>\n

It is also an offence to take photographs of law enforcement officers, publish them and disseminate them, in what is also an attempt to put an end to the viralisation of images of police officers through social media and in other common media such as television.<\/p>\n

The measure, according to analysts, is a consequence of the demonstrations and protests against the Catalan Parliament in 2012, in which numerous parliamentarians were detained and the identity of the police officers who had infiltrated the demonstrators was revealed. Something that also happened in the days of protest that accompanied the 15M in 2011 and the Puerta del Sol rallies.<\/p>\n

Squatters and escraches<\/strong><\/h3>\n

The \u2018Ley Mordaza\u2019 also refers to the prohibition of occupying a property against the will of its owner. An article that specialists have wanted to see as a reaction against the squatting movement, against the escraches to politicians and the demonstrations of the actions promoted by the Plataforma de Afectados por las Hipotecas in which banks have been occupied since 2010.<\/p>\n

Activities that may be considered irregular as public spectacles in all their nuances may be suspended by a public authority agent. Promoters of public entertainment or recreational activities who do not comply with the ban may be fined up to 600,000 euros. Furthermore, sporting, artistic or performing arts events will have to reserve a front row for law enforcement officers.<\/p>\n

On the other hand, only national armed forces such as the Guardia Civil or the National Police will have exclusive access to international police security databases. This is not the case for members of the regional police forces. The Ley Mordaza also makes it legal to carry out express returns at the border, especially in the conflictive areas of Ceuta and Melilla.<\/p>\n

Drug use in public areas is punishable by a fine of up to 30,000 euros, the same amount as overflying or accessing infrastructures or facilities that provide services considered basic to the interest of the community. If such access is preceded by a meeting or demonstration, the fine is up to 600,000 euros.<\/p>\n

Some measures included in the law appear to be simple adjustments of civility, as can be understood from the article that sanctions drinking while participating in street vending in a public place. Doing so, under the \u2018Gag Law\u2019, means a fine of up to 600 euros.<\/p>\n
